Terms of Service

The Promo Café, LLC is committed to making your shopping experience a great one. We are listing answers to some commonly asked questions. If we haven’t answered one of your questions or if you need clarification, please contact us at 888-392-9629 or email us at customerservice@thepromocafe.com.

Merchandise:

We encourage you to review a sample of the actual product before you place your order. We are very selective when it comes to the suppliers and manufacturers we work with but manufacturing variations are unavoidable. You must agree to accept merchandise with reasonable manufacturing variances in product material, color and packaging when placing an order with The Promo Café, LLC.

Site Pricing:

Is subject to change without notice. We do honor our quotes for 30 days.

Site Images:

The web site images are the best representation of products but are not actual products, therefore actual products may vary.

Acceptance:

We consider your online order as an acknowledgement of your order. The Promo Café, LLC accepts your order and will fulfill it based on our terms and conditions. Your acceptance of the order and payment of invoice will constitute a completed transaction. The Promo Café, LLC asserts that any contract hereby entered into has been made and is to be construed to New York State Law.

Cancellations and Changes to Existing Orders:

Once an order is accepted, we cannot guarantee our ability to make changes or cancellations to an order. All cancellation requests or requests for changes need to be made within 24 hours of placing an order and in writing. The Promo Café, LLC will make every effort to comply with your cancellation or change request.

Overs and Unders:

We try our best to fulfill your order in the exact quantity ordered, but this is not always possible. We reserve the right to ship and subsequently bill or credit your charge card or account for up to 10% over or under the ordered quantity.

Shipping Delays:

The Promo Café, LLC will not be held accountable for delays in delivery occasioned by acts of God or other circumstances over which we have no direct control. Factory shipments of delivery dates are the best estimates of our suppliers. The Promo Café, LLC will not be liable for any consequential or special damages arising from any delay in delivery.

Check Returns:

We will assess a $50.00 fee for any check returned for insufficient funds.

Net 15 Terms:

A 1.5% finance charge or the maximum charge permitted by law may be assessed against all accounts with past due balances. You will also be responsible for paying all of the company’s reasonable attorney’s fees and all collection agency fees incurred in the collection of any amount owed and not paid when due.

Sales Tax:

The Promo Café, LLC is required by law to collect all applicable state and local taxes for services and goods shipped to New York. Customers in other states may be required to remit use taxes. Please consult your tax advisor. Companies, individuals and organizations who are exempt from sales tax should provide us with a copy of their resale certificate.

Claims, Adjustments and Returns:

While we strive to make sure you are 100% happy with your order, we know there is that less than 1% chance you are not. We advise reviewing your order upon receipt. So if you have any problems with your order, please contact customer service at 888-392-9629 within 5 days of receipt. We handle all returns on a case by case basis.
